Terms of
service.

The rules that govern your use of the Demoship platform and services.

1. Acceptance of terms

By accessing or using the Demoship platform, website, APIs, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

If you do not agree to these terms, you may not access or use the Service.

2. Description of Service

Demoship provides an AI-powered platform for creating, personalizing, and sharing interactive product demonstrations. The Service includes demo creation tools, analytics, demo hosting, integrations, and related features as described on our website.

We may update, modify, or discontinue features of the Service at any time. We will provide reasonable notice for material changes that affect your use of the Service.

3. Account registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these terms. You may not use the Service to create demos that contain malicious code, infringe on intellectual property rights, or violate any applicable laws or regulations.

You may not attempt to reverse engineer, decompile, or disassemble any part of the Service, or use automated systems to access the Service in a manner that exceeds reasonable use.

5. Your content

You retain ownership of all content you upload, create, or share through the Service ("Your Content"). By using the Service, you grant Demoship a limited, non-exclusive license to host, display, and distribute Your Content solely for the purpose of providing the Service to you.

You are solely responsible for Your Content and represent that you have all necessary rights to use it with the Service. Demoship does not claim ownership of Your Content and will not use it for purposes other than providing the Service.

6. Intellectual property

The Service, including its design, features, code, documentation, and branding, is owned by Demoship, Inc. and protected by intellectual property laws. These terms do not grant you any rights to use Demoship trademarks, logos, or branding without prior written consent.

Demos you create using the Service are yours. The tools, templates, and AI models used to generate them remain the property of Demoship.

7. Subscription and billing

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are non-refundable unless otherwise stated or required by law.

We may change our pricing with at least 30 days notice. Price changes will apply to the next billing cycle after the notice period. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.

8. Data processing

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

For enterprise customers processing personal data through the Service, we offer a Data Processing Agreement (DPA) that complies with GDPR and other applicable data protection regulations. Contact us to request a DPA.

9. Service availability and SLA

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice.

Enterprise plan customers may be eligible for a Service Level Agreement (SLA) with defined uptime commitments and remedies. Contact our sales team for details.

10. Limitation of liability

To the maximum extent permitted by law, Demoship shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to Demoship in the twelve months preceding the claim.

11. Termination

Either party may terminate these terms at any time. You may terminate by closing your account. We may terminate or suspend your access if you violate these terms or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a reasonable period after termination. After that period, we may delete your data in accordance with our data retention policies.

12. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated terms.

13. Governing law

These terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
